[Riding Verse (RV)]

1. App Functionality

Community Creation & Management: Users of the Riding Verse (RV)mobile application may create and manage virtual communities cantered around bike riding interests, locations, or affiliations (e.g., Cites ,States, neighbourhoods, biking clubs, or ride-specific groups). Each community has administrators who can add/remove members, approve content, and set privacy (public or private). Each community created on the platform is subject to the following terms:
Creation Rights: Any registered user may initiate a new community, provided they agree to serve as the initial administrator and abide by the app’s community guidelines.
Administrative Roles: Community administrators (admins) have elevated privileges, including the ability to:
- Add or remove members (via invitations, phone number, or join requests)
- Approve or moderate content and media shared within the group
- Set or change community privacy status (public or private)
- Assign additional administrators or moderators
Membership Rules: Users may join communities by invitation, phone number lookup, QR code, or based on proximity/location-based recommendations (with explicit user permission).
Privacy Settings:
- Public Communities are visible to all users and may allow open joining or joining via request.
- Private Communities are hidden from public listings and accessible only through direct invitation or admin approval.
Data Display Within Communities: Member names, profile photos, and limited metadata (e.g., location relevance) may be visible within the group to foster trusted interaction, in accordance with the user’s privacy settings.
Community activities (including shared media, messages, and events) are governed by this policy and the community-specific privacy configurations set by its administrators
Invitations & Members: Members join via invitation links or by sharing their phone number. By providing contact information, you consent to the app using it to connect you to communities.
Events (Public/Private & Third-Party): Users can host public or private biking events (rides, meet-ups) and invite community members. The App also lists third-party events (e.g. organized by partners). RSVP and ticketing features use collected data for communication.
Real-Time Messaging: Within each community, members can send messages and announcements. Push notifications and in-app chats keep participants informed. Announcements may be broadcast by admins to all community members.

2. Data Collection

Personal Information: We collect basic account data such as your name, phone number, email address, and profile photo. These are considered personal data under Indian law (e.g. names, addresses, and phone numbers are listed as personal ). This information is used for account setup, authentication, and profile display.
User-Generated Content: Any media or content you upload (photos, videos, text for events or posts) is collected. You retain ownership of this content, but by uploading you grant us license to use it (see Intellectual Property below).
Device Information: Technical data such as your device model, operating system version, and IP address are collected automatically. This helps us ensure compatibility and security. IP addresses are also used to approximate location if GPS is unavailable.
Location Data: With your explicit consent, the App collects real-time GPS location to enable features like event check-ins and “find nearby riders.” You must grant location permission in your device settings for these features. If you deny location access, location-based features (community matching, navigation to events) will be disabled.
Sensor Data: With consent, we collect motion and gyroscope data to verify presence or activity during rides and Events (e.g. confirming you attended a ride). This data is used only to enhance features like safety verification and is treated as personal data requiring consent.

3. Data Use and Permissions

Purpose & Legal Basis: We use your data solely to operate the App and provide its services. For example, your phone number and email enable account creation and notifications; location data enables finding and joining nearby events; sensor data enhances event tracking. Under Indian law, all personal data processing is done on the basis of your consent or other lawful purpose (e.g. contract performance). We adhere to the principles of purpose limitation and data minimization meaning we collect only the data needed for each stated purpose.
Consent: We obtain clear, informed consent before collecting sensitive data (like location or health-related sensor data). Consent must be “free, specific, informed and unambiguous”. You may withdraw consent at any time via your account settings or by contacting support; withdrawing consent will disable the related feature (for example, disabling location access stops real-time mapping). Under current law, consent is the primary legal basis for processing personal data.
Data Sharing: We may share your information with third parties only as needed for the service (for example, providing your RSVP status to an event organizer or using a payment processor for purchases). All third-party sharing is governed by binding agreements (Data Sharing Agreements) as required under the Digital Personal Data Protection Act. For instance, our cloud storage and analytics providers are contracted to protect your data. We do not sell your personal information to advertisers; any sharing is limited to facilitating the App’s functionality.
Third-Party Access: Event partners or sponsors may receive certain data (e.g. your RSVP or chat messages) if you interact with their events. Such access is strictly controlled and only for the stated purpose (e.g. organizing an event). All partners must comply with applicable privacy laws.

4. User Obligations and Conduct

Compliance with Law: You agree to comply with all applicable laws (including the IT Act 2000 and Indian Penal Code) in using the App. You must not post or share any content that is illegal, defamatory, obscene, threatening, hateful, or otherwise objectionable. The App reserves the right to remove any content that it believes violates the law or these.
No Harmful Content: Do not use the App to send spam, malware, or unsolicited commercial messages. You shall not upload viruses, malicious code, or any material that could damage the App or users’ devices. Content that harasses or invades the privacy of others is prohibited.
Intellectual Property Respect: You must only upload or share content you have the right to use. Posting copyrighted material (images, videos, music) without authorization is not allowed. As a user, you must not infringe any third-party intellectual property; quick removal of reported infringing content is required.
Accurate Information: Provide accurate registration information (name, phone, email) and keep it updated. You are responsible for maintaining the security of your account credentials. If your account is compromised, you must notify us immediately.
Community Guidelines: You agree to follow community guidelines set by your group admins (e.g. respect privacy of members, avoid off-topic or abusive messaging). Repeated violation of rules may result in suspension. Users are responsible for their own communications; the platform is not liable for user messages, though we may moderate or remove content that violates these rules.

5. Intellectual Property

Our IP: All intellectual property in the App (including software, design, logos, and trademarks of Riding Verse is owned by EXPLORATIONS AND INNOVATIONS TECHNOLOGIES PRIVATE LIMITED or its licensors. This includes the underlying code, user interface, and branding. You may not copy or use our IP without permission.
Your Content: You retain ownership of any content you upload (photos, text, etc.). However, by uploading it to Riding Verse (RV), you grant Riding Verse Private Limited and EXPLORATIONS AND INNOVATIONS TECHNOLOGIES PRIVATE LIMITED a worldwide, royalty-free, sublicensable, non-exclusive license to use, reproduce, distribute, and display that content to provide the services (e.g. showing your photos to other users in a community). We do not claim ownership of your content, but we may archive it for backup and legal compliance.
License to Riding Verse (RV): This license allows the App to deliver your content as intended (e.g. include your photo in an event post) and to improve the service (e.g. use anonymous data for analytics). It also allows Riding Verse Private Limited and EXPLORATIONS AND INNOVATIONS TECHNOLOGIES PRIVATE LIMITED to create backups or caching of content. You may revoke this license by deleting your content/account, subject to retention laws.
Third-Party IP: You may not upload or share others’ copyrighted or trademarked material without permission. We respect copyrights and expect users to do the same. If you believe your intellectual property has been infringed on the App, you can notify us to take appropriate action.

6. Community Features and Admin Controls

Location Communities: The App may create or suggest communities based on geographic location. Location permission is required for matching you with local groups. You can join community groups relevant to your area or interests.
Admin Privileges: Community creators automatically become admins. Admins can invite or remove members, moderate chat and posts, and approve or cancel events in that community. Admins must enforce these Terms and the community’s own guidelines.
Ride Coordination and Paid Rides: Community members, clubs, organizations, and individual riders may create, publish, organize, and manage rides, tours, meetups, expeditions, training sessions, and other riding-related activities through the Platform. Such rides may be designated as public, private, invite-only, free, or paid at the discretion of the Ride Creator.Ride Creators, club administrators, community administrators, organizations, or other authorized users may independently determine participation requirements and may collect participation fees, registration fees, accommodation charges, food expenses, fuel-sharing contributions, membership fees, sponsorship contributions, donations, merchandise payments, security deposits, or other amounts associated with a ride or activity.At present, Riding Verse does not provide, operate, or manage an integrated payment collection system for user-generated rides or activities. Any QR code, UPI ID, bank account details, payment link, digital wallet, payment gateway, or other payment method shared through the Platform is provided solely by the respective Ride Creator, club administrator, community administrator, organization, or collecting party.Any payment made by a participant is made entirely at the participant's own discretion and risk. Riding Verse does not endorse, verify, guarantee, insure, supervise, monitor, or assume responsibility for any payment request, collection activity, financial arrangement, or transaction conducted by such parties.Riding Verse(app/website) Riding Verse Private limited and EXPLORATIONS AND INNOVATIONS TECHNOLOGIES PRIVATE LIMITED do not collect, receive, hold, process, manage, verify, supervise, guarantee, or control such payments and shall not be responsible for any payment-related matter, including but not limited to collection of funds, refunds, reimbursements, cancellations, postponements, chargebacks, financial disputes, misuse of funds, fraud, non-performance, organizer misconduct, participant claims, or losses arising from such transactions.All obligations and liabilities relating to payments, refunds, services, cancellations, participant claims, accommodations, merchandise, sponsorships, and ride-related activities shall remain solely with the respective Ride Creator, club administrator, community administrator, organization, or collecting party.Any dispute arising from such payments or ride-related services shall be resolved directly between the concerned parties without any responsibility or involvement of Riding Verse. The rights, obligations, limitations of liability, and disclaimers relating to ride-related payments are further governed by Section 8A (Paid Rides, Ride Fees, and Financial Responsibility.
Location Tracking: When enabled, members’ locations (only when using the App) may be used to show nearby riders or communities. Location tracking stops when the App is closed or permission is revoked. Location history is not stored beyond what is needed for real-time features.
Presence Verification: Optional features may use gyroscope or motion sensors to verify attendance at events (e.g. confirming a user attended a group ride). This data is used only for verification and safety purposes (to prevent false RSVPs) and requires your permission.

7. Device Permissions and Feature Access

Permission Scope: The App will request access to certain device features:
- Location: Used for community matching, showing rides on a map, and geofencing events.
- Camera/Microphone: Used for taking or uploading photos/videos, and optionally for audio/video calls or voice messages.
- Storage: Required to save and load your media files on the device and share them.
- Motion & Gyroscope: Used for activity recognition (e.g. bike movement detection) and presence checks.
All permission requests are presented clearly and require your affirmative consent. You may refuse or later revoke any permission via your device settings. If you revoke permission, the related feature will cease to function. For example, disabling location permission will prevent the App from providing GPS-based features.
Effect of Denial: Denying permissions will not affect your ability to use core community and messaging features, but location-based and sensor-based functionalities will be disabled.

8. Monetization, In-App Purchases, and Advertising

In-App Purchases: Riding Verse (RV) offers optional paid features (such as premium filters, subscription packs, or event tickets). Payment is made through the App Store/Play Store or our secure payment gateway. All payment transactions are subject to the store’s terms and our refund/cancellation policy (e.g. Google Play or Apple guidelines). Refunds, if any, are handled as per applicable laws and store policies.
Premium Features: Certain communities or features may require a subscription. Access to premium features will be clearly noted, and subscription fees and terms (recurring period, cancelation) disclosed before purchase. You authorize us to charge applicable fees to your payment method. We may change pricing at any time, without notice.
Advertising: The App may display advertisements. Advertisers do not receive your personal contact data unless you explicitly share it. We may use non-identifying data (e.g. location, device type, usage statistics) to show you relevant ads. All ad content is the responsibility of the advertiser; Riding Verse Private limited and EXPLORATIONS AND INNOVATIONS TECHNOLOGIES PRIVATE LIMITED does not endorse third-party ads. We may rotate or personalize ads, but any data used for ad targeting is done in accordance with your consent.
Content Restrictions: Users are strictly prohibited from uploading or sharing copyrighted material (images, music, videos) without permission. Posting infringing content may result in immediate suspension. We respect the copyright of others and will remove infringing content if properly notified.

8A. Paid Rides, Ride Fees, and Financial Responsibility :
Riding Verse enables clubs, communities, organizations, and individual riders ("Ride Creators") to create, publish, organize, manage, and promote rides through the Platform. Certain rides may require participants to pay participation fees, registration fees, accommodation contributions, food charges, fuel-sharing contributions, tour fees, membership contributions, security deposits, merchandise charges, sponsorship contributions, or any other amount determined by the Ride Creator. All such payments are established, requested, collected, received, managed, and controlled solely by the respective Ride Creator, club administrator, community administrator, organization, sponsor, vendor, or collecting party. Riding Verse(app) Riding Verse Private Limited and EXPLORATIONS AND INNOVATIONS TECHNOLOGIES PRIVATE LIMITED do not collect, receive, hold, manage, supervise, verify, guarantee, process, or control such payments unless expressly stated as an official payment service provided directly by the Company. Any QR code, UPI ID, bank account details, payment link, digital wallet, payment gateway, or other payment method displayed, uploaded, shared, promoted, or communicated by a Ride Creator through the Platform is provided solely by such Ride Creator. Riding Verse does not verify the authenticity, ownership, legality, security, regulatory compliance, financial standing, or intended use of any payment method and assumes no responsibility or liability in relation thereto.The Ride Creator shall bear sole and exclusive responsibility for:
• Collection, management, safeguarding, and use of ride-related funds;
• Accuracy of payment details, payment instructions, and ride-related representations;
• Delivery of the ride, tour, meetup, expedition, accommodation, meals, merchandise, sponsorship benefits, or any promised service;
• Compliance with applicable laws, permits, licenses, taxation requirements, insurance requirements, and regulatory obligations;
• Handling cancellations, postponements, modifications, route changes, participant removals, and operational decisions relating to the ride;
• Processing refunds, reimbursements, chargebacks, and participant claims;
• Resolving disputes arising from payments, services, accommodations, sponsorships, merchandise, or ride-related activities.
Ride Creators represent and warrant that they possess all permissions, licenses, approvals, insurance coverage, and legal authority necessary to organize and conduct the ride and shall bear sole responsibility for compliance with applicable laws and regulations. In the event that a paid ride is cancelled, postponed, modified, rescheduled, partially conducted, not conducted, inadequately delivered, or otherwise fails to meet participant expectations, all obligations relating to refunds, reimbursements, compensation, damages, and dispute resolution shall rest solely with the respective Ride Creator, club administrator, community administrator, organization, sponsor, vendor, or collecting party. Riding Verse shall not be liable for any loss, fraud, misrepresentation, unauthorized collection of funds, misuse of funds, theft, failure to provide services, cancellation, refund dispute, chargeback, breach of promise, negligence, misconduct, financial loss, property damage, personal injury, or any direct, indirect, incidental, consequential, punitive, or special damages arising out of or relating to payments made for a ride. Users acknowledge and agree that Riding Verse acts solely as a technology platform facilitating ride discovery, ride management, community interaction, navigation, communication, and coordination between riders. Riding Verse is not a party to any financial transaction, agreement, arrangement, contract, partnership, sponsorship, or obligation entered into between participants and Ride Creators. By making, requesting, collecting, receiving, transferring, or accepting any payment related to a ride listed on the Platform, all parties expressly agree that any dispute concerning such payment shall be resolved directly between the payer and the Ride Creator. Riding Verse shall have no obligation to mediate, investigate, adjudicate, process refunds, recover funds, enforce agreements, or otherwise participate in such disputes. To the maximum extent permitted by applicable law, Riding Verse(app) Riding Verse Private Limited and EXPLORATIONS AND INNOVATIONS TECHNOLOGIES PRIVATE LIMITED, including their directors, officers, employees, shareholders, affiliates, agents, contractors, licensors, representatives, successors, and assigns, shall be released from and shall not be liable for any claims, losses, damages, costs, liabilities, penalties, expenses, or disputes arising from or connected with any payment made in relation to a paid ride created by a club, community, organization, or individual rider. The provisions of this Section 8A shall survive suspension, termination, deletion of accounts, closure of communities, discontinuation of rides, discontinuation of services, and termination of these Terms and Conditions.
8B. Indemnification
You agree to defend, indemnify, and hold harmless Riding Verse(app) Riding Verse Private Limited, EXPLORATIONS AND INNOVATIONS TECHNOLOGIES PRIVATE LIMITED, its directors, officers, employees, affiliates, agents, contractors, licensors, representatives, successors, and assigns from and against any claims, demands, actions, proceedings, liabilities, losses, damages, penalties, fines, costs, expenses, and reasonable legal fees arising out of or relating to:
• Your access to or use of the Platform;
• Your participation in any ride, meetup, tour, expedition, community activity, event, or activity discovered, organized, promoted, coordinated, or attended through the Platform;
• Any ride, event, meetup, tour, expedition, or activity created, organized, managed, promoted, administered, or conducted by you;
• Any payment collected, received, managed, requested, transferred, or made by you in connection with a ride, event, community, club, organization, sponsor, vendor, or third party;
• Your interactions, communications, agreements, transactions, or disputes with any user, Ride Creator, participant, club administrator, community administrator, organization, sponsor, vendor, service provider, or third party;
• Any injury, death, illness, property damage, theft, financial loss, accident, claim, dispute, liability, or legal action arising from your participation in any ride or activity;
• Your violation of these Terms and Conditions, Community Guidelines, or any applicable law, regulation, permit, license, or governmental requirement;
• Your negligence, misconduct, unlawful conduct, omission, misrepresentation, breach of obligations, or infringement of the rights of any person or entity;
• Any content, information, photographs, videos, communications, or materials uploaded, shared, published, transmitted, or distributed by you through the Platform.
Users acknowledge that participation in motorcycle rides and related activities involves inherent risks and agree that they assume full responsibility for their actions, decisions, conduct, safety, vehicle condition, riding abilities, and compliance with applicable laws.
This indemnification obligation shall survive suspension or termination of your account, closure of communities, discontinuation of rides or services, and termination of these Terms and Conditions.

9. Termination and Account Suspension

User Termination: You may delete your account at any time by following the in-app instructions. Upon deletion, your personal data will be erased as described in Section 11. Any content you uploaded may be immediately removed or anonymized, subject to legal requirements. Unused in-app credits or pending transactions should be cleared before account closure.
App Termination: We reserve the right to suspend or terminate your account and access to the App at our sole discretion, especially if you violate these Terms (e.g. illegal conduct, policy breaches, or inactivity). Suspension may be without prior notice. We may also terminate all accounts if the Service is discontinued.
Data Retention: Upon termination or upon your request, we will cease processing or delete your personal data as soon as it is no longer needed for the purposes collected. For example, if you close your account or withdraw consent, we will erase or anonymize your data unless retention is required by law (such as tax records). Personal data will not be held longer than necessary. However, remnants of your data may remain in backup archives for a reasonable period for security, recovery, or legal compliance.

10. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Haryana, India.
Arbitration Clause: Except for matters that must be brought in court (e.g. intellectual property claims), any dispute or claim related to these Terms shall be resolved by binding arbitration in Sirsa, India, under the Arbitration and Conciliation Act, 1996. The arbitral award shall be final and binding, and judgment on it may be entered in any court of competent jurisdiction.
Ride Payment and Ride Creator Disputes :Any dispute arising from ride participation fees, registration fees, membership contributions, accommodation charges, food expenses, fuel-sharing contributions, merchandise purchases, sponsorship contributions, refunds, cancellations, postponements, ride modifications, ride-related services, or any other payment made in connection with a ride created by a club, community, organization, or individual rider shall be resolved solely between the participant and the respective Ride Creator. Riding Verse Private limited Riding Verse (app) and EXPLORATIONS AND INNOVATIONS TECHNOLOGIES PRIVATE LIMITED shall not be responsible for collecting, holding, managing, refunding, reimbursing, recovering, investigating, mediating, adjudicating, or resolving disputes relating to such payments and shall not be a party to any such dispute.
Assumption of Risk and Rider Responsibility : Participation in motorcycle rides, group rides, tours, expeditions, meetups, and related riding activities involves inherent risks, including but not limited to accidents, collisions, injury, death, property damage, theft, adverse weather conditions, road hazards, traffic conditions, mechanical failures, navigation errors, and the acts or omissions of other participants or third parties. Users voluntarily participate in such activities entirely at their own risk and are solely responsible for ensuring that they possess all licenses, registrations, permits, insurance coverage, protective gear, safety equipment, and physical capability required for participation. Every participant is solely responsible for maintaining a valid driving licence, vehicle registration certificate, insurance policy, pollution certificate, and all legally required documentation applicable to their vehicle and jurisdiction. Riding Verse does not organize, supervise, inspect, verify, endorse, or guarantee the safety, legality, quality, suitability, competence, or conduct of any ride, Ride Creator, participant, club, community, organization, sponsor, vendor, or service provider. To the fullest extent permitted by applicable law, Riding Verse Private LImited and EXPLORATIONS AND INNOVATIONS TECHNOLOGIES PRIVATE LIMITED shall not be liable for any injury, death, loss, damage, theft, expense, claim, liability, or legal action arising from participation in any ride or activity arranged, promoted, discovered, or coordinated through the Platform.
Injunctive Relief: Notwithstanding the above, EXPLORATIONS AND INNOVATIONS TECHNOLOGIES PRIVATE LIMITED and Riding Verse Private Limited may seek immediate injunctive or other equitable relief in courts of competent jurisdiction to prevent breach of confidentiality, intellectual property rights, or other legal rights, without the need for arbitration.

11. Data Security and Privacy Protection

Security Measures: We implement industry-standard security practices to protect your data. This includes encryption of data in transit (using HTTPS/SSL) and at rest (using secure databases and, where applicable, secure cloud storage). Access to databases and servers is strictly controlled and audited.
Legal Compliance: In accordance with Section 43A of the Information Technology Act, 2000, we maintain “reasonable security practices and procedures” to protect sensitive personal data. Failure to do so could result in liability. We also adhere to any rules under Indian law (e.g. IT (SPDI) Rules, 2011) requiring specific safeguards.
Encryption & Storage: Your personal data is stored on secure servers (located in India or compliant regions) with strong encryption and access controls. Payment information is handled by PCI-compliant processors; we do not store full payment card data on our servers. Authentication credentials (passwords) are hashed.
Privacy Practices: We do not store or share data beyond what is needed, as mandated by law. Our Privacy Policy (separate document) describes data subjects’ rights and how to exercise them (e.g. accessing or correcting your data). In line with DPDP Act principles, data accuracy is ensured and only kept for the time necessary.
Breach Notification: In the unlikely event of a data breach, we will notify affected users and authorities in accordance with applicable laws.

By using Riding Verse (RV) App, you acknowledge that you have read and agree to these Terms and that your use of the Service is at all times subject to applicable laws and regulations.

EXPLORATIONS AND INNOVATIONS TECHNOLOGIES PRIVATE LIMITED and Riding Verse Private limited retains the right to update these Terms from time to time. Material changes will be notified in-app or via email. Continued use of the App after updates constitutes acceptance of the new terms.
